Phase 2 of Awaab’s Law – New Guidance Released

The Ministry of Housing, Communities and Local Government has published new guidance this week regarding the implementation and enforcement of Phase 2 of Awaab’s Law. These new amendment regulations will come into effect on the 30th November 2026.

Since October 2025 under the Social Housing (Regulation) Act 2023, Awaab’s Law has applied to all damp and mould hazards. Under Phase 2, the requirements will extend to a wider range of significant hazards, including:

• Excess cold
• Excess heat
• Falls on the level (falls on the level, falls on stairs, and falls between levels)
• Structural collapse
• Fire and explosions
• Electrical hazards
• Domestic hygiene (personal hygiene and food safety)

A proactive approach to reduce the risk of damp and mould is essential. By undertaking a survey to detect the extent to which premises may be subject to damp and mould, issues can be identified early, reducing the cost of rectification, and mitigating the risk of legal consequences.
